Prospective Marriage Visa (subclass 300)
This visa is for you if you are engaged and want to marry your partner while in Australia. This visa will provide work and study rights, and will allow you to transition to a Partner Subclass 820/801 Visa with the possibility of permanent residence in Australia.
To be successful in applying for this visa you must:
- Be 18 years old or older.
- Have a sponsor.
- Not be in Australia when you apply for this visa.
- Intend to marry your partner before the visa expires.

How It Works
With this temporary visa, you must marry your partner before the visa expires. If you then intend to reside in Australia, you can apply for a temporary Partner visa (subclass 820) after you have been married but before your Prospective Marriage Visa ends. This will then allow you to directly apply for a permanent Partner visa (subclass 801). You can include family members in your visa application, however this will incur extra costs.
Duration
This visa is valid for a maximum duration of 9-15 months, which will be specified on your visa grant letter. During this time you must marry your intended spouse. You can extend your stay in Australia by then applying for a temporary partner visa (subclass 820) before your subclass 300 visa ends. You will then be eligible for a permanent partner visa (subclass 801).
Eligility
To be eligible for this visa, you must satisfy the following criteria:
- Be 18 years old or older.
- Have a sponsor who is either an Australian citizen, resident, or eligible New Zealand citizen.
- Be outside of Australia when applying.
- Meet the relationship requirements between you and your prospective spouse.
- Meet the health and character requirements (for all Australian visas).
- Have no outstanding debt to the Australian government.
- The attainment of this visa will be in the best interests of any children you have.
offshore partner visa (subclass 309/100)
With the temporary visa (subclass 309) you can:
- Reside, engage in employment, and pursue academic endeavors in Australia during the duration of your permanent Partner visa (subclass 100) application process.
- Enjoy unlimited travel to and from Australia, without any restriction.
- Have access to complimentary English language classes offered by the Adult Migrant English Program, provided you meet the eligibility criteria.
- Make an application to gain access to Australia’s comprehensive public healthcare scheme, known as Medicare.
Cost – from $8085 (visa fee only). This is paid for at the time that the temporary visa is granted, and no extra payment is required for the permanent visa.

How It Works
You must be involved in a long-term and continuous relationship with your spouse or de facto partner, who must be either an Australia citizen, permanent resident, or eligible New Zealand citizen. You are required to have a sponsor, which will most likely be your partner. It is necessary to be outside of Australia at the time of submission of the visa application, as well as any family members who are also included in the application. Once the permanent visa is granted, you will then be a permanent resident and your visa will change from a subclass 309 visa to a 100 visa.

The temporary visa is valid for as long as it takes to process the permanent visa, which is 32 months on average. The visa holder will then become an Australian resident who is able to stay permanently.
